Terms of Use

1. Acceptance of Terms

By downloading, installing, or using MyMovieToolkit ("the Software"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not install or use the Software. These terms constitute a legally binding agreement between you and MyMovieToolkit.

2. License Grant

Subject to your compliance with these Terms, MyMovieToolkit grants you a limited, non-exclusive, non-transferable, revocable license to use the Software on a single computer device for personal or commercial use, depending on your purchased plan.

3. Legal Use Obligations — CRITICAL

You agree to use MyMovieToolkit solely for lawful purposes. Specifically:

• Movie Downloads: You may only download video content that you have the legal right to access. This includes public domain content, Creative Commons licensed material, content you own the copyright to, or content explicitly authorized for download by the rights holder. Downloading copyrighted movies, TV shows, or any content without proper authorization is strictly prohibited.
• Subtitle Generation: You may only generate subtitles for video content that you legally possess or have permission to process. Do not use the Software to subtitle pirated or unauthorized content.
• Format Conversion: You may only convert video files that you own or have legal rights to modify. Converting DRM-protected content or content you do not own is prohibited.
• Subtitle Burn-In: You may only burn subtitles into video files where you hold the necessary rights to both the video and the subtitle content.

4. Prohibited Activities

You may not:

• Use the Software to download, distribute, or facilitate piracy of copyrighted material
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
• Remove or alter any copyright notices, trademarks, or proprietary markings
• Share, resell, sublicense, or transfer your license key to another party
• Use the Software to create competing products or services
• Circumvent or bypass any activation, licensing, or security mechanisms
• Use automated scripts or bots to interact with the Software or its download features
• Upload, transmit, or distribute malware, viruses, or harmful code through the Software

5. Intellectual Property

MyMovieToolkit and all associated logos, trademarks, software code, documentation, and user interfaces are the exclusive property of MyMovieToolkit. All rights reserved. You receive no ownership rights — only a limited license to use the Software as described herein.

6. User Content & Data

All video files, subtitle files, and processed content remain on your local device. MyMovieToolkit does not upload, store, or access your files on our servers. You are solely responsible for the content you process and any legal consequences arising from unlawful use.

7. Third-Party Services

The Software may interact with third-party websites and services for downloading content. MyMovieToolkit is not responsible for the content, policies, or practices of these third parties. Your use of third-party services is governed by their respective terms.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MYMOVIETOOLKIT DOES NOT GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL SYSTEMS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMOVIETOOLKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless MyMovieToolkit, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Software, violation of these Terms, or infringement of any third-party rights.

11. Termination

MyMovieToolkit may terminate or suspend your license immediately, without notice, for violation of these Terms. Upon termination, you must cease all use of the Software and destroy all copies. No refund will be issued for terminated licenses due to breach.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes shall be resolved in the courts of South Africa.

13. Changes to Terms

MyMovieToolkit reserves the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of the Software after changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
